defense allowing them to be on the cutting edge of driving while intoxicated - DWI defense at all times.
Both Lubbock defense attorneys are licensed in the State of Texas and the Northern District
Court (Federal Court) of the State of Texas.
Both are members of the State Bar College of Texas.
Both attorneys are doggedly independent, and believe in challenging everything
for their clients' defense to be successful.
As a matter of course, they are ready to fight your case by bombarding the
District Attorney with extensive pre-trial motions, demonstrative evidence,
photographs, witness testimony, videos, defense experts, essential
cross-examination of the prosecution's witnesses, and, of course, your
testimony.
Stephen Hamilton has a certificate of completion of the Robert F. Borkenstein
course. This is the same training the state intoxilyzer experts attend. As a
result of this training, I am able to better contest any intoxilyzer evidence
that the prosecution introduces.
Stephen Hamilton has completed training under the Department of Transpiration
regulations as a breath test operator and technician. Because of this I know the
strengths and weaknesses of this particular intoxilyzer...and I can use this
knowledge to better defend you.
DUI Help Member
The law firm owns its own Intoxilyzer 5000 and Portable Breath Test Machines.
Stephen Hamilton has been invited to lecture to attorneys throughout the State
of Texas on the Intoxilyzer and breath test cases.
Stephen Hamilton has completed training in blood alcohol analysis and forensic
blood analysis. Because of this training I know the errors and fallacies of a
blood test that the prosecution will introduce.
Clients come from across Texas to retain their services. Both defense attorneys focus on
criminal cases with the emphasis of their practice devoted to DWI / DUI defense cases.
They focus on cases in the West Texas and in the Texas panhandle.
"Stephen Hamilton is Board Certified in Criminal Law by the Texas Board of
Legal Specialization"
Why is this important? Well consider that in the entire State of Texas, there
are over 67,000 licensed attorneys and there are only 826 Board Certified
Criminal Lawyers!! In Lubbock County, at last count, there are over 600
licensed attorneys and only 6 are Board Certified in Criminal Law -- and one of
these is a prosecutor! That means that less than 1% of all the lawyers in
Lubbock County are criminal law specialists. In fact, hiring a board certified
criminal lawyer means that your lawyer has satisfied various requirements that
few lawyers (LESS THAN 1 % IN LUBBOCK) meet.
So What is a Criminal Law Board Certified Attorney?
An attorney who is Board Certified by the Texas Board of Legal Specialization in
Criminal Law must have experience in the preparation and trial of serious
criminal matters. The attorney must also have extensive knowledge of state and
federal constitutional law, evidence, procedure and penal laws involved in the
trial of these matters. A relatively small percentage of all Texas lawyers are
board certified in a particular area of specialization.
To become Board Certified in Criminal Law, an attorney must have:
---- Been licensed to practice law for at least five years
---- Devoted a required percentage of practice to criminal law for at least
three years
---- Handled a wide variety of criminal law matters to demonstrate experience
and involvement
---- Attended criminal law continuing education seminars regularly to keep legal
training up to date
---- Been evaluated by fellow lawyers and judges
---- Passed a day-long written examination covering state & federal criminal law
The Texas Board of Legal Specialization was created by, and operates under the
authority of, the Supreme Court of Texas. Its members are appointed by the
President of the State Bar of Texas. The Board administers the program by which
an attorney may earn a certificate of special competence in a particular field
of law. The program is voluntary and is funded entirely by fees imposed on
participating attorney.
